These Billing Terms and Conditions ("Terms") govern the payment obligations and processes between Home Luxury Essentials ("Company," "we," "us," or "our") and the customer ("Customer," "you," or "your"). By accessing our website or purchasing our products, you agree to be bound by these Terms.

  • Prices: All prices are listed in US Dollars (USD) and are subject to change without prior notice.
  • Taxes and Fees: Prices exclude applicable taxes, duties, and charges unless specified otherwise during checkout.

2.2 Payment Methods

We accept the following payment options:

  • Credit/Debit Cards: Visa, MasterCard, American Express, and Discover.
  • PayPal: Secure payment with the option to use "Pay Later" for eligible customers.
  • Shop Pay: Flexible installment payment options are available (e.g., 4 interest-free payments).
  • Other Methods: Apple Pay, Google Pay, and other region-specific payment methods where applicable.

2.3 Payment Due Date

  • One-Time Purchases: Payment is required at the time of checkout.
  • Subscriptions: Payment is due on the first day of each billing cycle, as specified during the subscription signup process.

3. Invoicing

  • Invoice Issuance: Invoices will be issued upon order confirmation or on the renewal date for subscriptions.
  • Delivery Method: All invoices are sent electronically to the email address provided by the Customer.
  • Customer Responsibility: Ensure that your billing information is accurate and up-to-date to avoid disruptions.

4. Late Payments

4.1 Interest on Late Payments

  • Late Fee: A late payment interest of 1.5% per month (or the maximum allowed by law) will be applied to any overdue amounts.

4.2 Suspension of Services

  • Service Suspension: We reserve the right to suspend or terminate services if payment is not received within 10 days after the due date.
  • Reinstatement: Services will be reinstated upon full payment of outstanding balances, including any late fees.

5. Disputed Charges

  • Notification Period: Disputes must be reported in writing within 15 days of the invoice date.
  • Contact Information: Submit disputes to support@homeluxuryessentials.com with your invoice number and a detailed explanation.
  • Resolution: We will investigate and resolve disputes promptly.

6. Refunds and Credits

  • Policy Reference: Refunds and credits are provided according to our Return and Refund Policy.
  • Processing Time: Approved refunds will be processed to the original payment method within 14 days.

7. Taxes

  • Customer Responsibility: You are responsible for all applicable taxes, including sales tax, VAT, GST, or other similar charges.
  • Tax Exemption: Provide a valid tax exemption certificate during purchase to avoid applicable charges.

8. Billing Errors

  • Corrections: We will promptly correct any billing errors identified.
  • Overcharges: Refunds or credits will be issued for any overcharges.
  • Undercharges: Any undercharges will be invoiced to you for payment.

9. Subscription and Recurring Payments

9.1 Automatic Renewal

  • Renewal Terms: Subscriptions automatically renew at the end of each billing cycle unless canceled as per our Cancellation Policy.

9.2 Cancellation

  • Effect of Cancellation: Access to services will remain active until the end of the billing period.

  • Payment Processor: Payments are processed via Shopify Payments and PayPal, ensuring PCI DSS compliance.
  • SSL Encryption: Transactions are encrypted using Secure Socket Layer (SSL) technology.

11. Changes to Billing Terms

  • Modification Rights: We may update these Terms at any time.
  • Notification: Changes take effect upon posting the updated Terms on our website.
  • Acceptance of Changes: Continued use of our services constitutes acceptance of updated Terms.

  • No Liability for Indirect Damages: We are not responsible for indirect, incidental, or consequential damages.
  • Maximum Liability: Our liability is limited to the amount paid by you for services in the 6 months preceding the claim.

  • Jurisdiction: These Terms are governed by the laws of Pennsylvania, United States, without regard to conflict of law principles.
